Terms of Service

1. Founding Beta Status

Vintage Moments AI is currently operating as a concierge founding beta. The public iOS application has not launched. All services described are manually fulfilled digital services delivered by the Vintage Moments AI team. By placing an order, you acknowledge and accept this status.

2. What This Service Is

Vintage Moments AI applies vintage visual treatments — including era-inspired color grading, film grain, vignettes, borders, framing, and album-style presentation — to photographs you already own. The service does not offer face swapping, deepfakes, identity replacement, celebrity impersonation, or synthetic video of any kind.

3. Eligibility

You must be at least 18 years of age to place an order. By using this service, you confirm you have the legal capacity to enter into these Terms.

4. Customer Ownership and Consent

By submitting photographs, you confirm that:

• You own each submitted photograph or hold explicit permission from the copyright holder.
• You have obtained permission from every recognizable person appearing in each photograph.
• For photographs containing minors, you are the parent or legal guardian, or hold documented guardian authorization.
• You have read and agree to the Acceptable Use Policy.

5. Prohibited Submissions

You may not submit photographs or use the service for:

• Face swapping or identity replacement
• Deepfakes or synthetic impersonation of any person
• Celebrity, politician, influencer, or public-figure impersonation
• Photographs of persons who have not consented
• Photographs of minors without guardian authorization
• Creation of misleading evidence, defamation, or harassment
• Fraudulent, illegal, or exploitative purposes
• Sexualized content of any kind
• Government or identity document manipulation
• Any other use prohibited by the Acceptable Use Policy or applicable law

6. Payment

Payment is processed by Paddle, which acts as the merchant of record. The founding beta price is USD$4.99 as a one-time payment with no automatic renewal or subscription. Taxes may be calculated and applied by Paddle at checkout depending on your location.

7. Delivery

Delivery of completed vintage editions is targeted within approximately 24 hours after your photographs are submitted, reviewed, and accepted for processing during the founding beta. This is a target, not a guarantee. Actual delivery time may vary based on submission volume and photograph requirements.

Delivery begins after: (1) payment is completed; (2) photographs are submitted; (3) photographs satisfy submission requirements; and (4) the submission is accepted for processing.

8. Results Variation

Demonstration images show the intended visual direction. Actual results vary based on the resolution, lighting, composition, and quality of the submitted photographs. We do not guarantee that results will be identical to demonstrations.

9. License

Upon delivery of your order, you receive a personal-use license to the delivered vintage edition files. This license covers personal, non-commercial use, including printing for personal display and sharing with family and friends. Commercial licensing is not included unless separately agreed in writing.

You retain all ownership rights to your original submitted photographs. Vintage Moments AI does not acquire ownership of your source photographs.

Vintage Moments AI retains all rights to the service software, algorithms, layouts, and platform. We will not use your submitted photographs for public demonstrations without your separate explicit written permission.

10. Refunds

Please review our full Refund Policy. In summary: full refunds are available before customized processing begins. Once processing starts, refunds may be limited due to the personalized digital nature of the service. Statutory consumer rights remain unaffected.

11. Service Refusal

We reserve the right to refuse, cancel, or refund orders that violate these Terms, the Acceptable Use Policy, or applicable law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, GREENBORN INFOTECH shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of this service. Our total liability for any claim shall not exceed the amount paid for the relevant order.

Nothing in these Terms limits liability that cannot lawfully be excluded, including liability for fraud, personal injury caused by negligence, or statutory consumer rights.

13. Applicable Law

These Terms are governed by the laws of India. Nothing in these Terms affects your statutory consumer rights under applicable local law.
